Overview
Chris' practice emphasis is on handling health care, commercial litigation, Employee Retirement Income Security Act (ERISA) litigation and other employee benefit matters. He has represented national health care companies, individual physicians, physician groups and other health care professionals in complex, multiparty litigation, regulatory compliance and transactional matters. He has also worked with employee plans, administrators and fiduciaries regarding life, health and disability benefits including all phases of ERISA litigation in all Texas federal districts. Some of his more recent matters include:
- Advising health care providers and others involved in the health care industry regarding the impact of recently enacted health care reform legislation on existing and future ventures and how to structure such ventures to be compliant with the new law.
- Representation of physicians and physician groups on the legal structure of operations involving delivery of designated health care services including laboratory services and diagnostic imaging as such operations impact, federal and state anti-kickback, and self-referral laws.
- Representation of hospitals on licensing, compensation, medical staff relations, contractual matters and employee relations as they impact federal and state licensing, anti-kickback, self-referral and false claim laws in Texas and other states including representation with Texas regulatory agencies concerning waiver and modification of the same.
- Representation of medical device manufacturers and distributors in the preparation and negotiation of consulting contracts and licensing agreements regarding the development of new products.
- Winning a $1.4 million judgment on behalf of a local businessman for trademark violations, breach of contract and conversion including award of punitive damages and reversal of fraudulent conveyance by the defendant.
