The Munsch Hardt Land Use & Entitlements group includes attorneys who represent landowners, developers and local governmental entities in a wide variety of land development entitlement matters including zoning, platting, development permits, development agreements, annexation agreements, establishment and protection of grandfathered rights, tax abatements, tax increment financing districts, other economic incentive agreements, special use districts and other forms of private/municipal participations. We advise and assist clients on federal and state environmental regulations including compliance with the federal Endangered Species Act (ESA). Our client representation includes local and state legislative matters as well as litigation involving development related issues.
Representative Deals & Suits
- Representation of the owners of a Las Colinas development in Irving, Texas in numerous transactions since the inception of the development including the restructure of the public debt of municipal utility districts and creation of tax increment financing zone.
- Representation of a developer in the negotiation of a annexation and utility agreement for a 315 acre lakefront community with 120 acres of open space on Lake Travis in the Austin, Texas area.
- Representation of various landowners in the negotiation, drafting and processing of habitat conservation plans under the Endangered Species Act (ESA).
- Representation of a university system in negotiating one of the first development agreements in the state of Texas, and establishing land use regulations for university owned property.
- Representation of a developer in the negotiation of a single development agreement with the city of Austin, Texas to establish consistent land use regulation standards for school facilities.
- Representation of a landowner in a multi-year effort to entitle a family owned ranch in Austin, Texas including securing a permit under ESA, lobbying for federal grant money to purchase a portion of the ranch, passing state legislation to require a fair market valuation method that yielded higher land values for the client and leveraging the government purchase of a portion of the ranch to obtain greater entitlements on the remainder of the ranch.
