The Munsch Hardt Mixed-Use Developments group has a dedicated team that represents investors and developers of high visibility, nationally recognized hotel and mixed-use hotel, condominium, rental residential, retail and entertainment projects in both urban revitalization and resort settings. We handle a variety of legal matters for our mixed-use clients including acquisitions and dispositions, development and construction, leasing, lending and finance, partnerships and joint ventures, management agreements, franchise agreements, land use and entitlements, environmental and insurance. We have worked on these mixed-use projects in the United States, Mexico, South America and the Caribbean. Our attorneys work in tandem with our developer clients on these mixed-use projects from concept to completion attending to all of the details such as land acquisition, joint development agreements with co-developers, loan and equity negotiations, construction contracts, and leasing of retail and specialty areas including spas, restaurants, bars and nightclubs. Many of our recent mixed-use engagements have involved transit orientated developments (TOD) for which we are a leader in this emerging area. We have found large mixed-use projects are an intricate three dimensional puzzle and we have significant experience in making sure the puzzle pieces fit together to create a successful project.

Representative Deals & Suits
  • Representation of a developer in the acquisition of approximately 60 acres of older apartment projects in Dallas, Texas and redevelopment of the site into dense, mixed-use retail and multifamily and townhome residential areas.
  • Representation of an American private equity firm in a large international arbitration regarding a failed business venture in Dubai. The private equity firm had contracted with a local Dubai entity for the purchase of 38 acres of prime real estate for the purpose of building a mixed-use development. This was the first land-sale contract executed by a non-Dubai citizen, completed shortly after the laws in Dubai were changed to attract outside investors. As the client started to clear the land for development, it was discovered that there were issues with title to the property. The client halted construction and the opposing party canceled the contract. Munsch Hardt arbitrated the matter in the Dubai International Arbitration Center before a world renowned English arbitrator.
  • Representation of a developer in the redevelopment of two separate historic hotels and the addition of adjacent condominium towers in Dallas, Texas.
  • Representation of a developer in the development of a high-rise hotel, condominium and retail project in downtown Milwaukee, Wisconsin.
  • Representation of a developer in the development of a 250 room hotel together with 60 high-end residential condominiums located on top of the hotel, an additional 80 residential condominium units located in an adjacent tower and approximately 30,000 square feet of retail space in Dallas, Texas.
  • Representation of a hotel developer in the development of a $650 million hotel/condominium/apartment project in Los Angeles, California.
  • Representation of a developer in the development of a 56 acre hotel, restaurant and entertainment master planned community in Grapevine, Texas.
