Land

The Munsch Hardt Land group is experienced in the representation of land owners including land acquired for development, commercial tracts acquired for investment, timberland and ranchland. We handle a variety of legal matters for landowners including acquisitions and dispositions, development and construction, lending and finance, partnerships and joint ventures, land use and entitlements, environmental and insurance.

Often, we are called upon to represent developers involved in developing master planned residential communities and residential communities with town center mixed-use components. We are involved in every stage of such projects from the initial acquisition of small, individual tracts to the construction financing, negotiation of lot contracts and lot closings with homebuilders. We have the practical knowledge necessary to assist our clients in negotiations with city agencies, engineers, and prospective builders and developers on a wide variety of matters such as land use and entitlements, impact fee agreements, construction contracts, development agreements for infrastructure and utilities, retention/detention ponds, amenity centers, golf courses, property owners' associations and restrictive covenants. Our Energy & Environmental group is also frequently called upon to assess contamination issues affecting such land.

  • Representation of a purchaser in the acquisition of 6,000 acres near Aspen, Colorado for a residential golf development.
  • Representation of a buyer of over 15,500 acres of land (plus additional Bureau of Land Management (BLM) land) relating to the development of a wind farm project in Western Wyoming.
  • Representation of a developer in the acquisition and development of a 734 acre, master planned community in Western Fort Worth, Texas with 2,000 single family detached residential units and 30 acres of commercial/retail work.
