Multifamily Projects

The Munsch Hardt Multifamily Projects group represents some of the largest and most active multifamily owners and developers in the nation. We handle a variety of legal matters for multifamily clients including acquisitions and dispositions, development and construction, leasing, lending and finance, partnerships and joint ventures, land use and entitlements, environmental, insurance and telecommunications. Of particular note, Munsch Hardt was named by Multi-Housing News as one of the "Top 24 Multifamily Housing Law Firms in the Nation." Much of the work of our nationally recognized Telecommunications group involves handling telephone, video, Internet, rooftop antenna and wireless service transactions for many of the nation's largest multifamily owners.

We have special experience in the development of student housing projects at major universities as well as in the development of affordable multifamily housing including tax credit transactions.

Several of the attorneys in our Multifamily Projects group have formerly served as in-house counsel for apartment development companies, giving them a comprehensive understanding of our clients' due diligence and development issues. In working with our clients on acquiring and developing multifamily projects, we have experience with multiple forms of debt and equity financing including tax-exempt bonds, traditional bank debt, low income housing tax credits, mezzanine financing and institutional financing programs.

  • Representation of a developer in the financing and development of a 228 unit urban apartment project in the Arts District of downtown Dallas, Texas.
  • Representation of a national multifamily investor in the acquisition of 12 apartment projects in four states over a two year period.
  • Representation of a developer in the development of a master leased off-campus student housing project at a major university.
  • Representation of a national development company in the negotiation of a partnership with an institutional investor to provide over $500 million in equity for development.
  • Representation of a purchaser in the acquisition of 32 apartment projects in nine states with multiple layers of equity and financing involving the seller, lender and our client.
  • Representation of an owner in the refinancing of 17 multifamily projects located in two states.
  • Representation of an owner in the refinancing of 10 apartment projects throughout the United States through a Fannie Mae securitized facility.
  • Representation of a publicly traded multifamily Real Estate Investment Trust (REIT) in the acquisition and financing of the transactions including and subsequent to Initial Public Offering (IPO)/merger with a privately held real estate company that owned 18,000 apartment units in several states.
  • Representation of an owner in a $100 million permanent construction loan take-out (forward) facility secured by a portfolio of apartment projects.
  • Representation of a purchaser in the acquisition of 15 apartment projects in four states financed with a $52 million securitized facility.
