Retail Centers
The Munsch Hardt Retail Centers group includes attorneys whose practice is primarily devoted to the representation of owners, investors, developers, managers and tenants of retail projects. We handle a variety of legal matters for these retail clients including acquisitions and dispositions, development and construction, leasing, lending and finance, partnerships and joint ventures, land use and entitlements, environmental, insurance and telecommunications. We represent retail landlords in project leasing as well as major retail tenants in their leasing of space in retail projects.
Retail real estate presents unique issues not found in other types of real estate projects such as signage requirements, reciprocal easement agreements (REA), co-tenancy provisions, parking requirements, exclusivity rights and out lot parcels and our attorneys are well-versed in such matters. We also have substantial experience incorporating retail stores into larger mixed-use developments.
- Representation of a purchaser in the purchase, redevelopment, refinancing and ultimate sale of power centers in Texas, Oklahoma, Louisiana, Colorado, New Mexico, Arizona and Arkansas, and former grocery store anchored sites and outparcels for redevelopment, lease up and pad site development for multiple retail real estate investors and developers.
- Representation of a developer in the leasing and management for a large mixed-use development (office and retail) just outside downtown Dallas, Texas.
- Representation of a bank in the acquisition and development of retail banking facilities located throughout Texas.
- Representation of a purchaser of a 450,000 square foot mall located in Arizona and the subsequent development of a retail supercenter and adjacent pad sites.
- Representation of two rapidly expanding, publicly traded, restaurant chains in the acquisition and lease transactions throughout the United States.
- Representation of a national developer of neighborhood automotive/repair stations.
- Representation of purchasers of several restaurant chains including performance of all real estate and corporate due diligence under an expedited timeframe.
- Representation of a major power center retail tenant in its leasing activities throughout Texas.
- Representation of national music and video rental chains, a take-out home style restaurant chain, a bagel restaurant chain, a computer and technology store chain, an athletic shoe store chain and a discount merchandise store chain with retail leases.
- Representation of a developer in the acquisition of approximately 60 acres of older apartment projects in Dallas, Texas and redevelopment of the site into dense, mixed-use retail and multifamily and townhome residential areas.
