Munsch Hardt's Health Care group represents hospitals; health care facilities; physicians, nurses and health care professionals; physician and management service organizations; health care companies; insurers and others in a broad spectrum of matters involving state and federal health care laws including the physician self-referral law (Stark), anti-kickback statute, False Claims Act (FCA) and Health Insurance Portability and Accountability Act (HIPAA). We provide representation and counsel on regulatory compliance and other matters impacting strategic planning, development, entity formation, contracting, operations and litigation. In addition, our attorneys educate and advise clients on the wave of new health care legislation including the Patient Protection and Access to Care Act (PPACA) and Health Care and Education Reconciliation Act (HCERA) as well as Health Information Technology for Economic and Clinical Health Act (HITECH) and electronic health record (EHR) regulations. Members of the firm's health care team offer knowledgeable counsel that reflects a thorough understanding of the law governing health care activities.

We represent clients in the sale or acquisition of facilities, organization of joint ventures, and mergers and acquisitions. In addition, we guide clients through a variety of contractual endeavors including third party reimbursement and managed care, development and license agreements for medical devices, management service agreements, and space and equipment leasing. We are routinely called upon by our clients to advise on operational issues impacting today's health care providers such as handling regulatory audits, government relations, facility disaster planning, staff credentialing, health care business operation management, licensing and certification, risk management and delivery of care including the patient’s right to receive and refuse treatment, physician practice services and reimbursement. We are also committed to representing our clients through all phases of litigation, trial and appeal, and handle complex litigation matters including class actions, professional and general liability, business and employment litigation, licensing board actions and Medicare recoupment actions. Our health care attorneys also compliment Munsch Hardt's Employment & Labor group in Employee Retirement Income Security Act (ERISA) litigation in federal district courts throughout the state.
