Mike Huddleston presented a paper and moderated a panel on the topic of “Settlement Without The Carrier: Dealing With Sweetheart Deals and Mary Carter Traps.” The panel includes Robin Cohen of McKool Smith, John E. Heintz of Dickstein Shapiro, and Audra L. Thompson of Duane Morris LLP. The discussion focused on the approaches taken by multiple jurisdictions as to when and if an insured can settle without the participation of the carrier. This includes an analysis of recent trends as to the use of Coblentz agreements, so-called Sweetheart Deals and Mary Carter Agreements.
