Secured an ultimate recovery of over three times the State’s original offer in a condemnation case in Denton County after the State offered to pay less than a quarter of a million dollars for the client’s 19,736 square-foot property. 

Drafted a construction agreement including an arbitration provision. After the relationship turned sour, the Owners sued the principal of the Contractor in Dallas County for allegedly fraudulently inducing them into the contract. The trial court denied the principal’s motion to compel arbitration.  On an interlocutory appeal, the Fifth Circuit reversed and upheld the clear language of the provision covering the Contractor’s principal. Additionally, the Court of Appeals awarded Munsch Hardt’s client its attorney fees and costs incurred during the appeal. 

Obtained the dismissal of an investigation and administrative action pending in front of the Equal Employment Opportunity Commission (EEOC) against our client premised on the claims of a disgruntled employee who alleged he was impermissibly discriminated against at the jobsite. As part of the dismissal order, the EEOC found it was unable to conclude that our client had violated the applicable statutes.

Obtained a directed verdict in favor of our client on a contractual matter where the other side sought attorneys’ fees and costs. At trial, the court agreed with our position and dismissed the other side’s claims with prejudice. The other side did not appeal.

Favorably settled a class action brought against our client. The plaintiff alleged our client breached contracts with each class member and violated numerous provisions of the Deceptive Trade Practices Act. The case successfully settled at mediation for less than a quarter of the plaintiff’s $1.5 MM demand.

Obtained a summary judgment that awarded our client specific performance on a purchase agreement and attorneys’ fees after the seller refused to close on the real estate transaction.

Serves as labor and employment counsel to an early childhood education agency, which is currently one of the largest non-profit organizations in the Dallas-Fort Worth Metroplex. Munsch Hardt handles matters such as day-to-day employment counsel, internal investigations, and union avoidance.
